Zusammenfassung Wird ein Arzt beschuldigt, einen Behandlungsfehler begangen zu haben oder steht ein solcher Vorwurf nur im Raum, so sollte der Betroffene selbst von Anfang an an einer Klärung interessiert sein. Dies gilt für beide Gruppen von Fällen (1. Fehlverhalten unstreitig, z.B. Seitenverwechslung; 2. Fehler wird vom Patienten oder dessen Angehörigen behauptet, weil der subjektiv erwartete Erfolg nicht eingetreten ist). Auf die Grundüberlegungen für die Gutachtenserstattung von den Anknüpfungstatsachen bis zu den Schlußfolgerungen wird kurz eingegangen.

Summary A physician who is charged with malpractice should be concerned about early clarification, even if only such a reproach has been made. This is true for both groups of cases: 1. if the malpractice is evident, e.g. confusing the sides; 2. if the malpractice is maintained by the patient or his relatives because the treatment success they expected was not achieved. The basic considerations on expert statements from the fundamental facts up to the conclusions will be briefly discussed.
