Summary In the course of supplementary alcohol tolerance tests EEG-examinations have been applied systematically for the purpose to further secure the reaction to alcohol, after it has been proved by experiments with animals that the encephalogram is being changed in one sense through alcohol in the direction of a frequency retardation and an amplitude increase of the spontaneous rhythms. In addition to the value pro mille the speed of the concentration rise and the fact whether the electroencephalographic tracings were made during the phase of rising or falling of the curve of alcohol in the blood. Among 40 people, for whom these examination were considered to be necessary in order to judge the penal responsibility at the time of the act, four cases with bio-electrical changes were found, where the expected frequency retardation an amplitude increase in respect of the level of alcohol in the blood had been substantially exceeded. Regarding the circumstances and the psychophysical aberrations it could be followed from this that an abnormal to pathological alcohol effect in the sense of a lowered alcohol tolerance existed. Furthermore the encephalogram in several cases proved to be informative insofar that the psychopathological symptoms as shown during the alcohol tolerance test could be identified as being psychogenic-demonstrative in supplementing the observation of behaviour.

Zusammenfassung Bei nachträglichen Alkoholtoleranzprüfungen wurden zur weiteren Objektivierung der Reaktionsweisen auf Alkohol systematisch EEG-Untersuchungen herangezogen, nachdem bekannt und tierexperimentell erwiesen ist, da\ das hirnelektrische Bild durch Alkohol einsinnig in Richtung einer Frequenzerniedrigung und Amplitudenvergrö\erung der Spontanrhythmen verändert wird. Zu beachten sind neben dem Promillebetrag die Geschwindigkeit des Konzentrationsanstiegs und der Umstand, ob die Ableitung in der Anstiegs- oder Abbauphase der Blutalkoholkurve erfolgte. Unter 40 Personen, bei denen diese Untersuchungen zur Beurteilung der strafrechtlichen Verantwortlichkeit zur Tatzeit für erforderlich gehalten wurden, fanden sich vier Fälle mit bioelektrischen Veränderungen, welche die zu erwartende Frequenzerniedrigung und Amplitudenvergrö\erung bei dem jeweiligen Blutalkoholgehalt zum Teil erheblich überschritten. Unter Würdigung der Tatumstände und der psychophysischen Abweichungen konnte daraus auf einen abnormen bis pathologischen Alkoholeffekt im Sinne einer herabgesetzten Alkoholtoleranz geschlossen werden. Daneben erwies sich das EEG in mehreren Fällen dahingehend aufschlu\reich, da\ die während der Alkoholtoleranzprüfung aufgetretenen psychischen Auffälligkeiten in Ergänzung zur Verhaltensbeobachtung als psychogen-demonstrativ identifiziert werden konnten.
