    Notes: Summary The pharmacodynamic effects of muzolimine and furosemide were compared in a single dose cross-over study in 8 patients on regular dialysis treatment, who had a residual diuresis of more than 300 ml/day. The study periods comprised two dialysis-free intervals of 3 days. On the second dialysis-free day either muzolimine 240 mg or furosemide 240 mg was administered orally. Urine was collected in 12-h periods on the pre-treatment, treatment and post-treatment days, and the excretion of sodium, potassium, urea and creatinine were measured. After administration of muzolimine 240 mg urine volume rose to twice that of the previous day, and sodium excretion increased approximately threefold. In contrast, the effect of furosemide 240 mg was not as pronounced; the diuresis was only 1.6 times that on the previous day and natriuresis was only 2.2 times as large. Excretion of potassium and creatinine was only slightly increased by either substance. The elimination of urea was increased by both substances to the same degree as the corresponding increase in diuresis.

    Description / Table of Contents: Zusammenfassung Die Arbeit stellt an Hand von Beispielen aus der in- und ausländischen Rechtsprechung die Haftung des Arztes für eigenes und fremdes Verschulden bei der Delegation ärztlicher Aufgaben an Assistenzärzte dar. Die Übertragung ärztlicher Tätigkeiten auf Assistenzärzte ist nur bei laufender Überwachung und nur im Rahmen der bereits erworbenen Fertigkeiten des Assistenzarztes bei begründetem Vertrauen des delegierenden Arztes zulässig. Für Verschulden haftet insoweit der liquidierende Arzt. Besteht ein Vertrag zwischen Arzt und Patient, so muß der Arzt gem. § 278 BGB für ein Verschulden des von ihm zugezogenen Assistenzarztes ohne Entlastungsmöglichkeit einstehen. Dagegen entfallen deliktische Schadensersatz- und Schmerzensgeldansprüche gegen den delegierenden Arzt, wenn dieser die sorgfältige Auswahl und Überwachung des beigezogenen Assistenzarztes beweisen kann, § 831 BGB. Der Assistenzarzt haftet — mangels eigener Vertragsbeziehungen zum Patienten — aus Delikt auf die in seinem Kreis verlangte Sorgfalt. Er hat — jedenfalls als angestellter Arzt — einen arbeitsrechtlichen Freistellungsanspruch für gefahrgeneigte Arbeit gegen seinen Arbeitgeber.
    Notes: Summary The lecture discusses and exemplifies the physician's liability for negligence with regard to delegation of medical responsibilities to a medical assistant. A physician may only delegate medical activities to a trusted and carefully supervised medical assistant when these tasks fall within the assistant's range of skills. In this context the rule of “respondeat superior” applies. Under contract law the physician is held liable for negligent conduct of his medical assistant in the performance of the delegated responsibilities, § 278 BGB. However, the physician is not held responsible under tort law, if he can prove that he selected and supervised his negligent assistant carefully, § 831 BGB. In the absence of a contractual relationship to the patient, the medical assistant's liability under tort law corresponds with the standard of care applied to a skillful medical assistant. At least the employed medical assistant may claim from his employer release from liability for slight negligence.

    Description / Table of Contents: Zusammenfassung Der Unterschied zwischen Behandlung und Versuch liegt nicht in der Unsicherheit des Ergebnisses, sondern darin, daß von einer Standardmethode abgewichen wird. Chirurgische Forschung ist zu ermutigen, wenn das Projekt wissenschaftlich zweckmäßig, das Verhältnis von Vorteil and Gefahr annehmbar und die Zustimmung nach Aufkldrung des Patienten gegeben ist. Auch sollte nach Möglichkeit eine Ethikkommission mit dem Projekt befaßt werden. Die geringe Zahl von Gerichtsentscheidungen deutet darauf hin, daß Gerichte selten wegen nicht erfolgreicher Forschung angerufen werden.
    Notes: Summary The difference between treatment and experimentation does not lie in the uncertainty of the result, but in not following a standard procedure. Experimentation in surgery should be encouraged if the new procedure is scientifically sound, if there is an acceptable riskbenefit ratio, if the patient has given his informed consent, and if an ≫ethical committee≪ has been asked. The small number of cases suggests that experimentation in surgery seldon ends up in court.
